Resolving Disputes with Confidence: How SIMC and Proxtera Mediation Services Empower Your Business

What is Mediation and How Mediation Works on Proxtera

In the world of commerce, disputes can arise despite the best intentions and thorough planning. Mediation offers a practical, effective way to resolve these issues amicably.

This process ensures all parties can communicate their concerns, work towards mutual understanding, and achieve a satisfactory resolution without prolonged litigation and excess cost.

On the Proxtera Trade Portal, we facilitate mediation in collaboration with the Singapore International Mediation Centre (SIMC) to provide a structured, virtual, reliable platform for dispute resolution.

Understanding Mediation

Mediation is a voluntary, confidential process in which a neutral third party, known as a mediator, assists disputing parties in reaching a mutually agreeable solution.

Unlike litigation or arbitration, mediation emphasizes collaboration and allows the parties to maintain control over the outcome.

It’s designed to be less adversarial, focusing on the interests and needs of all involved rather than determining who is right or wrong.

Key Benefits of Mediation:

  • Confidentiality: Discussions and outcomes remain private, protecting the reputation and interests of the parties involved.
  • Cost-Effective: Mediation can be less expensive than court proceedings or arbitration, especially as it can be done virtually.
  • Time-Efficient: Mediation is scheduled and concluded much faster than traditional litigation.
  • Preserve Relationships: By fostering a collaborative environment, mediation helps maintain business relationships.

How Mediation Works on Proxtera’s Trade Portal

Proxtera offers a seamless integration with SIMC to facilitate mediation for our users. Here’s a step-by-step guide on how the process works:

  1. Click on the Mediation Button on Proxtera
Users can initiate mediation when a dispute arises by clicking the “Mediation” button on the Proxtera platform.
  2. Enter Details and Submit Mediation Form
Users are prompted to enter relevant details about the dispute and submit a mediation form. This form captures the necessary information to understand the context and nature of the dispute. Both parties have to agree to mediation. If the mediation is triggered through Proxtera, Proxtera will share the details of the related trade directly with SIMC.
  3. Appointment of a Mediator
Upon submission, SIMC will appoint an experienced mediator who is well-versed in the relevant field and has a proven track record of resolving similar disputes.
  4. Setting Up a Date and Time for Mediation
The mediator will coordinate with all parties to schedule a convenient date and time for the virtual, mediation session. Flexibility is critical, ensuring that all parties can fully participate.
  5. Submission of Relevant Documents to SIMC
Parties must submit all relevant documents and evidence to SIMC before the mediation session. This ensures that the mediator has a comprehensive understanding of the case beforehand.
  6. Commencement of Mediation
The mediation session will commence at the agreed-upon time. During the session, the mediator facilitates discussions, helping parties articulate their concerns and interests, explore options, and work towards a mutually satisfactory resolution.
